Terms & Conditions of Service

These “Terms & Conditions of Service” govern the relationship between 402 Arts Collective ("we," "us," or "Organization") and the student or legal guardian ("you") regarding our arts education services.

1. Lesson & Class Subscription Services

1.1 Enrollment: By enrolling in a subscription for lessons (private) or classes (group), you authorize the 402 Arts Collective to charge your payment method on a recurring monthly basis. 

1.2 Billing Cycle: Subscriptions are billed on the 1st day of each month. 

1.3 Account Management:

  • An electronic payment method is required for registration in lessons, classes, or workshops.

  • Tuition for lessons and classes is due on the 1st of each month before the next cycle of lessons or classes occur. 

  • If tuition is not paid by the 1st of the month, the 402 Arts Collective has the option to suspend registration until the balance is paid. 

  • Automatic tuition subscription payments require each student to maintain a functioning payment method (credit card, debit card, or ACH account) from their Student Portal access. 

  • Workshop payments are required in full at the time of registration. 

1.4 Price Adjustments: 

  • Mid-month enrollments are prorated based on the determined start date of the lessons or classes. 

  • We reserve the right to change subscription fees with 30 days' notice.

  • There is a one-time registration fee for each new student registering for LESSONS. 

  • All active and/or retired military personnel are eligible for a discount.

1.5 Months with a 5th Session: 

  • LESSONS: Subscription fees for lessons include any months with a 5th session.

  • CLASSES: Subscription fees for classes do not include the added cost of a 5th session. Invoices will reflect an additional fee for the added class session.

2. Workshop Registrations

2.1 Scope: This applies to one-time workshop events that come with a limited number of sessions (1x, 4x, etc).

2.2 Payment: Full payment is required at the time of booking to secure your spot. 

2.3 Transfers: If you are unable to attend a workshop

  • You may transfer your purchase to another individual, provided you notify us 24 hours in advance.

  • You may not transfer your purchase to a different workshop. 

3. Subscription Cancellation & Refund Policy

3.1 Subscription Cancellation: 

  • Notification to cancel a LESSON subscription must be received at least 30 days before your next billing date. 

  • Notification to cancel a CLASS subscription must be received at least 2 weeks before your next billing date. 

3.2 Refunds & Account Adjustments: 

  • Once a cancellation notice is received for a LESSON subscription, a prorated billing adjustment will be added accordingly to fulfill the remaining 30 days only. 

  • Prorated adjustments for CLASS cancellations are not available. 

  • There are NO REFUNDS provided for partial months or unused attendance for lessons or class(es). 

  • WORKSHOPS are NON-REFUNDABLE. 

4. Attendance & Make-Up Policy

4.1 Student Absence: There are no credits or make-up sessions provided if a student misses a lesson, class, or workshop, including both planned and unplanned absences.

4.2 Artist Instructor Absence:

  1. The Artist Instructor will attempt to reschedule the lesson, class, or workshop; OR

  2. The 402 Arts Collective will issue a prorated credit for the cost of that specific lesson, class, or workshop.

4.3 Tardiness: Lessons, classes, and workshops start and end at the scheduled time regardless of the student’s arrival time.

5. Holiday & Inclement Weather Policy

5.1 Scheduled Holiday Closures: The Studio will be closed in observance of the following holidays: New Year’s Day, Easter Sunday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve, and Christmas Day.

  • Lessons & Classes: Subscription fees are calculated based on an annual average of lessons and classes. No credits or refunds will be issued for scheduled holiday closures. Subscription fees are used to provide Artist Instructors directly impacted by a holiday closure with the benefit of holiday pay. 

  • Workshops: No special events or workshops will be scheduled during these periods unless explicitly advertised.

5.2 Inclement Weather & Emergency Closures: The safety of students, Artist Instructors, and staff is our priority. In the event of extreme weather (e.g., blizzard, iced road conditions, dangerously severe cold temperatures) or local emergencies, the 402 Arts Collective’s locations will close.

  • Closure Decisions: Due to the multiple school districts in the Omaha Metro area, as well as the diverse stance each district takes on each inclement weather event, the 402 Arts Collective generally follows our own weather-closure schedule. We will notify you of any closures by email, SMS messaging, and through social media postings by 12:00 PM on the day of potentially impacted lessons/classes/workshops.

  • Lessons & Classes: If the 402 Arts Collective closes due to weather, we will not offer credits or refunds. Subscription fees are used to provide Artist Instructors with compensation for their preparation efforts and investment in time and materials for lessons and classes.

  • Workshops: If a special event is canceled due to weather, the 402 Arts Collective will work with the Artist Instructor to announce a rescheduled date. If you are unable to attend the rescheduled date, you will receive a prorated refund for the canceled event/workshop session.

5.3 Facility Issues: In the rare event of a facility-related closure (e.g., power outage or water main break), the 402 Arts Collective will communicate urgent updates by email and SMS messaging. 

  • Lessons & Classes: If the 402 Arts Collective closes due to facility issues, we will offer credits for all impacted lessons and classes. 

  • Workshops: If a special event or workshop is canceled due to facility issues, the 402 Arts Collective will work with the Artist Instructor to announce a rescheduled date. If you are unable to attend the rescheduled date, you will receive a prorated refund for the canceled workshop session.

6. Intellectual Property & Media Release

6.1 Curriculum: All teaching materials and methods remain the property of 402 Arts Collective and/or the Artist Instructors. 

6.2 Media Release: By registering for lessons, classes, or workshops, you are permitting the 402 Arts Collective to use photographs or videos of students and their artwork for promotional purposes.

7. Conduct and Liability

7.1 Code of Conduct: We reserve the right to terminate services immediately, without refund, for behavior that is disruptive, disrespectful, or dangerous. 

7.2 Liability Waiver: The 402 Arts Collective is not responsible for personal injury or loss of personal property. 

You agree to waive all claims against 402 Arts Collective arising from participation in classes or events.

Acceptance of Terms

By completing the registration for lessons, classes, or workshops, you acknowledge that you have read, understand, and agree to these Terms and Conditions.
